Scope
These terms apply to orders placed through the Bonsai Sushi website unless expressly agreed otherwise. Before placing an order, the buyer should read these terms carefully.
Sales Terms
These terms govern the ordering of goods and services through the Bonsai Sushi website, the relationship between seller and buyer, and the main rules on payment, delivery, complaints, and consumer protection in Estonia.
Scope
These terms apply to orders placed through the Bonsai Sushi website unless expressly agreed otherwise. Before placing an order, the buyer should read these terms carefully.
The buyer may be an adult natural person with legal capacity or a legal entity placing an order through the website. By placing an order, the buyer confirms that the submitted details are accurate and up to date.
The seller may change the assortment, prices, delivery conditions, campaigns, and these terms of sale. The terms valid at the time the order is confirmed by the seller or the website system apply to the order.
Product descriptions, composition, available options, add-ons, and prices are shown on the website as accurately as reasonably possible. Images are illustrative and may differ slightly from the actual presentation.
All prices are displayed in euros. Unless expressly stated otherwise, prices include applicable taxes, while delivery fees are shown separately during checkout depending on the selected zone.
If, after an order is placed, a product turns out to be unavailable, the seller may offer a substitute, a partial refund, or cancellation of the relevant item subject to agreement with the buyer.
To place an order, the buyer selects products, configures options and add-ons where available, adds items to the cart, enters contact and fulfilment details, and confirms the order in accordance with the instructions shown on the website.
The seller may request clarification if the submitted information is incomplete, inaccurate, doubtful, or if the delivery address does not match the selected zone, delivery conditions, or technical ability to fulfil the order.
The sales contract is deemed concluded once the order has been confirmed by the seller or the website system, provided that the order can be fulfilled and the buyer has completed the required checkout steps.
Available payment methods are displayed on the website and may depend on the seller's settings, the selected fulfilment method, the delivery zone, and the technical availability of the relevant services.
Where the buyer chooses a payment method requiring prepayment, the seller may start fulfilling the order only after successful payment confirmation. For cash or other pay-on-receipt methods, the checkout rules shown on the website apply.
If payment is not successfully completed, the seller may decline to process the order or suspend fulfilment until payment confirmation is received where necessary.
The buyer may choose pickup or delivery if these options are available at the time of checkout. Delivery depends on the zone, working hours, restaurant workload, and other conditions displayed on the website.
Preparation and delivery times are estimates and may change due to kitchen workload, traffic, weather, technical disruptions, or other circumstances beyond the seller's reasonable control.
The buyer must provide a correct address, phone number, and other details necessary for receipt of the order. Additional costs caused by inaccurate or incomplete information may be charged to the buyer to the extent permitted by law.
If the buyer wishes to change or cancel the order, the buyer should contact the seller as soon as possible. The ability to change or cancel depends on the stage of order fulfilment.
Under applicable law, including consumer protection rules, the standard 14-day right of withdrawal generally does not apply to perishable goods, prepared food, or goods made or prepared according to the buyer's specific order.
If fulfilment has not yet started, the seller may, where possible, agree to cancel the order and refund the amount in full or in part. If preparation has already begun or the order has been handed over for delivery, the seller may refuse cancellation within the limits permitted by law.
The buyer should inspect the order upon receipt and notify the seller as soon as possible of obvious defects, missing items, incorrect products, or other issues. To speed up handling, it is advisable to include a photo and a brief description.
The seller is liable for non-conformity of goods to the extent required by applicable law. If a defect is confirmed, the seller may, at its discretion and in accordance with law, offer replacement, partial refund, repeat performance, or another reasonable remedy.
The seller is not liable for delays or failures caused by force majeure, technical failures of external services, acts of third parties, traffic conditions, or other circumstances that the seller could not reasonably prevent.
Personal data received when placing an order or using the website is processed in accordance with the privacy policy published on the website.
The buyer may submit a complaint to the seller using the contact details provided on the website. The seller aims to respond to substantiated complaints within a reasonable time and to resolve disputes primarily through negotiation.
If no agreement can be reached, a consumer may contact the Consumer Disputes Committee at the Estonian Consumer Protection and Technical Regulatory Authority (TTJA), Endla 10A, 10122 Tallinn, Estonia, website: https://ttja.ee.
The relationship between buyer and seller is governed by the law of the Republic of Estonia, taking into account mandatory rules of European Union law and consumer protection requirements.
If any provision of these terms is found invalid, the remaining provisions remain in force. The current valid version of the terms of sale is always published on the website.
